The Rugby Dietitian is a trading name of Freney Health Pty Ltd (ABN 67 696 131 914). References to “The Rugby Dietitian”, “we”, “us”, and “our” throughout these Terms refer to Freney Health Pty Ltd.
By accessing this website, engaging our services, purchasing products, or interacting with The Rugby Dietitian (“we”, “us”, “our”), you agree to these Terms of Service. Please read them carefully before proceeding.
These Terms apply to: athletes, teams, and organisations; individual consultation clients; purchasers of digital products or resources; website visitors and subscribers; and international users.
If you do not agree with these Terms, please discontinue use of our website and services.
1. Scope of Services
The Rugby Dietitian provides:
Sports nutrition consulting and coaching (including telehealth)
Performance nutrition education and programs
Athlete resources, guides, and digital products
Biomarker testing and result interpretation services
Professional advisory services for teams and organisations
Services may be delivered globally via digital platforms including video, phone, and written communication. All services are provided by or under the supervision of a qualified Accredited Practising Dietitian (APD).
2. Professional Scope & Important Limitations
Please read this section carefully. It defines the nature and limits of our services.
Our services constitute professional dietetic advice, not medical diagnosis or treatment. Specifically:
Nutrition advice is evidence-based but does not replace diagnosis or treatment by a medical practitioner
Biomarker test interpretations are provided in a nutrition and performance context — they are not medical diagnoses
If you have a medical condition, suspected illness, or clinical health concern, you should consult your GP or a relevant medical specialist
In the event of a medical emergency, call 000 immediately
You acknowledge that individual results from nutrition advice vary based on adherence, training, health status, genetics, and other factors outside our control, and that no specific performance, health, or body composition outcomes are guaranteed.
3. Client Responsibilities
To allow us to deliver safe and effective services, you agree to:
Provide accurate, complete, and up-to-date information about your health, medications, conditions, and lifestyle
Disclose any injuries, medical conditions, eating history, or relevant circumstances before or as they arise
Seek medical clearance where we or your own practitioner recommends it
Implement nutrition recommendations responsibly and within your own capacity
Notify us promptly of any adverse reactions or concerns arising from advice given
Failure to disclose relevant information may compromise the safety and effectiveness of advice provided. We are not liable for outcomes arising from incomplete or inaccurate information you provide.
4. Telehealth & Online Service Delivery
Where services are delivered via telehealth (video, phone, or written communication):
You acknowledge the inherent limitations of remote assessment compared to in-person consultation
You are responsible for ensuring you have appropriate technology and connectivity
You consent to your consultation being conducted via the agreed digital platform (e.g. video call, email, or Acuity Scheduling)
You must not record consultations without our prior written consent
These services are provided from Australia. If you are accessing services from another country, you are responsible for ensuring that doing so complies with local laws.
5. Use of Artificial Intelligence Tools & Consent
This section requires your informed consent. By engaging our services, you acknowledge the AI tools described below are used in our practice.
We use AI-powered tools to assist with service delivery. Under the Australian Privacy Act 1988 and the OAIC’s guidance on AI, we are required to disclose this and obtain your consent before processing your sensitive health information through these systems.
Consultation Recording via Google Gemini (Google Workspace)
We may use Gemini, the AI assistant integrated into our paid Google Workspace account, to record, transcribe, or summarise consultation sessions. This means consultation content — including health information you share — may be processed by Gemini within our Google Workspace environment.
Key protections:
Under Google’s contractual commitments to Google Workspace customers, your data is NOT used to train or improve Google’s AI models without our permission.
Content is not reviewed by human reviewers outside our Workspace domain without permission.
All existing Google Workspace security and access controls apply.
Your consent: We will ask for your explicit verbal or written consent before recording any consultation. You may decline recording at any time without affecting your access to our services. If you decline, the session will proceed without recording.
Nutrition & Meal Plan Analysis via Claude (Anthropic)
We use Claude, an AI assistant developed by Anthropic, to assist with analysing dietary data, meal plans, and nutrition information as part of preparing your recommendations.
Key protections:
We apply data minimisation — wherever possible, client reference codes are used rather than your full name or identifiers when entering information into Claude.
Only information necessary for the specific analytical task is entered.
Under Anthropic’s terms for paid/Teams accounts, your inputs are not used to train Anthropic’s AI models by default.
All AI-generated analysis is reviewed by our qualified dietitian before being applied to your care. No clinical decisions are made solely by AI.
Data processing location: Anthropic’s servers are located in the United States. Submitting your information for AI-assisted analysis constitutes a cross-border disclosure under APP 8. Your consent to this is captured through your agreement to these Terms.
Your Rights in Relation to AI Processing
You have the right to:
Decline recording of your consultation — this will not affect service delivery
Request that your information not be processed through AI tools where practicable (note this may limit some analytical capabilities)
Ask questions about how AI tools are used in your care at any time
Withdraw consent to AI processing — contact us at info@therugbydietitian.com
AI tools support but do not replace professional dietetic judgement. Your registered dietitian is responsible for all recommendations made to you.
6. Privacy & Data Protection
We are committed to protecting your personal and health information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Our full Privacy Policy is available at www.therugbydietitian.com and forms part of these Terms. By engaging our services, you acknowledge and agree to the terms of that policy, including:
The collection and use of sensitive health information for service delivery
Storage and processing of data using third-party platforms (Google Workspace/Gemini, Anthropic/Claude, Squarespace, Zapier, Acuity Scheduling) located in the United States
AI-assisted processing as described in Section 5 above
Retention of health records for a minimum of 7 years (adults) or until age 25 (minors)
7. Intellectual Property
Ownership
All content created by or for The Rugby Dietitian remains our proprietary intellectual property. This includes:
Nutrition methodologies, frameworks, and programs
Educational materials, guides, meal plans, and athlete resources
Digital products, templates, and online course content
Branding, logos, graphics, and website content
Consultation notes and personalised plans created for you
No ownership rights transfer to clients. Materials provided to you are for your personal use only.
Licence of Use
Unless otherwise agreed in writing, you receive a limited, non-exclusive, non-transferable licence to use materials provided for your personal education and performance purposes only. This licence does not permit you to republish, sell, distribute, or use materials professionally with your own clients.
Breach of intellectual property terms may result in immediate termination of services and legal action.
8. Confidentiality
We treat all client information in strict confidence. De-identified and anonymised data may be used for service improvement, professional education, or general case discussions in a form that cannot identify you. We will never disclose identifiable client information to third parties without your consent, except where required by law.
9. Fees, Payments & Refunds
Fees are as published on our website or confirmed in writing at time of booking. Payment is required in advance unless otherwise agreed. Refunds, cancellations, and rescheduling are governed by our separate Refund Policy at www.therugbydietitian.com, which operates alongside and does not override your rights under the Australian Consumer Law.
10. Australian Consumer Law — Consumer Guarantees
This section cannot be modified or excluded. These are your automatic legal rights under Australian Consumer Law.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If a service fails to meet a consumer guarantee, you are entitled to a remedy. For a major failure, you may cancel and receive a refund for the unused portion. For a minor failure, we will re-perform or fix the service. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.
11. Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
Indirect, consequential, or incidental losses arising from use of our services
Losses arising from your failure to disclose relevant health information
Losses caused by circumstances outside our control (e.g., platform outages, third-party errors)
Errors or inaccuracies in AI-generated analysis that were not reasonably detectable upon professional review
Our total liability for any claim is limited to fees paid for the relevant service. These limitations do not apply to liability that cannot be excluded by law.
12. Website Use
By using our website, you agree not to use it for any unlawful purpose, attempt to gain unauthorised access to our systems, distribute harmful code, misrepresent affiliation with The Rugby Dietitian, or scrape content without permission.
13. Third-Party Platforms & Links
We use third-party platforms to deliver our services, including Google Workspace (Gemini), Anthropic (Claude), Squarespace, Zapier, Acuity Scheduling, and payment processors. Your use of these platforms may also be subject to their own terms and privacy policies. Our website may link to third-party sites for which we are not responsible.
14. Automated Decision-Making
Disclosure required under Australian Privacy Act amendments (effective December 2026 — implemented early for transparency).
AI tools are used to support — not replace — clinical decision-making. Gemini assists with recording and note-taking. Claude assists with nutritional data analysis. In all cases, a qualified Accredited Practising Dietitian reviews AI-generated outputs before they are applied to your care. No significant clinical decisions are made by automated systems alone.
15. Termination of Services
We may suspend or terminate access to services for breach of these Terms, intellectual property misuse, professional or ethical concerns, or legal obligations. Where termination is our decision rather than due to your breach, we will refund fees for unused services in accordance with our Refund Policy and the ACL.

17. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales. Where mandatory consumer or data protection laws apply in your jurisdiction, those rights are not affected.
18. Updates to These Terms
We may update these Terms periodically. The updated version will be posted on our website with a revised date. Continued use constitutes acceptance. We will make reasonable efforts to notify active clients of material changes.
